Egypt: Death Sentence for Muslim Brotherhood Member Referred to Mufti

A court in Egypt referred on Sunday the death sentence against one defendant to the Grand Mufti, setting September 23 as the day of the final sentence. The defendant is among 683 others who are involved in the 2013 sit-in by supporters of former president Mohammed Morsi in Cairo’s Rabaa al-Adawiya Square. The Public Prosecution said that dozens had gathered in front of Adwa police station in Minya Governorate and stormed it following the dispersal of Rabaa and Nahda sit-ins in August 2013, killing two policemen in addition to damaging public property. They damaged police vehicles and official documents at the station, helping 31 detainees escape. They also stole arms and ammunition.  The indictments include video footage of more than 163 alleged perpetrators of acts of violence and vandalism and the testimony of more than 30 eyewitnesses, contrary to technical reports and investigations carried out by security services. In the first trial, the court sentenced 183 defendants to death, including Supreme Guide of the Muslim Brotherhood Mohamed Badie, two to life, and acquitted 498 others. The Court of Cassation has previously ruled that the previous sentences issued by the Minya Criminal Court for death and life imprisonment against 36 of the defendants shall be revoked. The verdicts issued were only against the defendants in custody as the law specifies different procedures to be taken against those in absentia. They are usually retried by the criminal court immediately after their arrest or their surrender.  In this context, the Cairo Criminal Court announced on Sunday that it will issue on August 12 its verdict in the retrial case of Badie and seven other prominent leaders of the Muslim Brotherhood for inciting and committing acts of violence in Gizas El Bahr El Aazam district following the violent dispersal of the sit-ins in 2013.  The retrial came after the Court of Cassations verdict to revoke 25-year prison sentences issued in 2014 against the defendants, who include Mohamed el Beltagy and Essam el Erian.  They are accused of inciting violence, terror and murder as well as forming a gang to attack citizens and supplying it with arms and funds.
