martialed Berlin, Dec 7, SPA -- A U.S. army tank company commander accusedof murdering a member of a militia in Iraq will be court martialed on the charges, the Army said Tuesday. Following the military equivalent of a civilian grand juryinvestigation, 1st Armored Division commander Maj. Gen.Martin Dempsey decided to go ahead with the court martialof Capt. Rogelio Maynulet, division spokesman Maj. MichaelIndovina said in a statement. The murder charge stems from a May 21 incident near Kufain Iraq when Maynulet was leading his tank company on apatrol. They came across a BMW sedan believed to be carryingmilitiamen loyal to Shiite leader Muqtada al-Sadr and achase ensued. U.S. soldiers fired at the vehicle, woundingboth the driver and passenger. During the hearing, a fellow officer testified thatMaynulet told him a medic said the driver, who had a severehead wound, was beyond hope and that he shot him out ofcompassion. The killing was caught on video by a U.S. dronesurveillance aircraft, and the footage was played backduring the so-called Article 32 hearings after the publicand press were removed from the courtroom. The hearingofficer said the footage was being kept classified becauseit could reveal the Army's capabilities in Iraq.
