Jeddah court transfers traffic fines worth SR20000 on vehicle of divorcee to account of former husband

The General Court in Jeddah issued a final verdict transferring the fines for committing traffic violations imposed on a vehicle owned by a divorcee, to the account of her ex-husband. This was after the woman proved to the court that he was fully responsible for the violations, for which the total fines amounted to around SR20000. Okaz/Saudi Gazette has learnt from sources that a female citizen filed a lawsuit before the traffic circuit under the General Court, in which the woman stated that she owned a vehicle registered in her name but did not use it. It was in the possession of her husband before their divorce. During that period, traffic fines totaling around SR20000 were recorded against the vehicle. In the lawsuit, the divorcee demanded that all the fines resulted from the traffic violations shall be transferred to the perpetrator. She produced evidence, including a witness, a previous driving authorization in the defendant’s name, and WhatsApp conversations that took place between her and the defendant in this regard. In a remote court session during which the defendant failed to attend, the traffic circuit at the court reviewed the evidence submitted by the plaintiff and other attached documents. After reviewing the Traffic Law and its executive regulations, the court ruled to transfer the traffic violations, worth SR20000, and register them in the name of the actual perpetrator -her ex-husband. The ruling was pronounced and was considered as a final ruling against the parties involved in the case. The ruling was appended with a directive that all ministries and other government agencies are required to work to implement this ruling by all applicable legal means, even if it leads to the use of coercive force by the police. Commenting on the verdict, Saudi female lawyer Maysar Al-Jeelani said that traffic circuits are judicial departments under the jurisdiction of general courts, and are specialized in lawsuits arising from traffic accidents and violations of the Traffic Law and its executive regulations. She noted that the Supreme Judicial Council issued a circular to all courts considering all types of lawsuits, in which the value of the original claim does not exceed SR50000, was one of the simple claims that do not accept objection on appeal, which means that the ruling becomes final without any of the parties to the dispute having the right to appeal the ruling. “Saudi courts are now completing procedures and issuing final verdicts on cases within a short span of time according to an integrated justice system, granting all parties their rights stipulated in a system involving three levels of litigation,” Maysar said
